IMPORTANT: CAREFULLY READ THE FOLLOWING LICENSING AGREEMENT ("AGREEMENT").
This AGREEMENT is a legal agreement between you (either an
individual or a single entity) and J3 Limited for the JDatabase Wizard V1 software
product , which includes computer software and electronic documentation
("SOFTWARE"). By installing, copying, or otherwise using the SOFTWARE,
you agree to be bound by the terms of this AGREEMENT. If you do not agree to the
terms of this AGREEMENT, do not install or use the SOFTWARE; if applicable, you
may return the SOFTWARE to your place of purchase for a full refund.
Subject to the payment of the applicable license fees, and subject to the terms and conditions of this Agreement, J3 Limited hereby grants to you a non-exclusive, non-transferable right to use one copy of the specified version of the SOFTWARE.
If you are an entity, J3 Limited grants you the right to designate one individual within your organization ("NAMED USER") to have the right to use the Software in the manner provided below.
You may install a copy of the Software on a computer and freely move the Software from one computer to another, provided that you are the only individual using the Software.
You may not reverse engineer, decompile, or disassemble the
SOFTWARE, except and only to the extent that such activity is expressly
permitted by applicable law notwithstanding this limitation.
You may not rent, lease, or lend the SOFTWARE PRODUCT.
THE SOFTWARE IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, J3 LIMITED DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT WITH RESPECT TO THE SOFTWARE. YOU ASSUME RESPONSIBILITY FOR SELECTING THE SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS, AND FOR THE INSTALLATION OF, USE OF, AND RESULTS OBTAINED FROM THE SOFTWARE. WITHOUT LIMITING THE FOREGOING PROVISIONS, J3 LIMITED MAKES NO WARRANTY THAT THE SOFTWARE OR GENERATED CODE WILL BE ERROR-FREE OR FREE FROM INTERRUPTIONS OR OTHER FAILURES OR THAT THE SOFTWARE AND GENERATED CODE WILL MEET YOUR REQUIREMENTS. SOME STATES AND JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL J3 LIMITED BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR FOR ANY AND ALL OTHER DAMAGES OR LOSSES) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF J3 LIMITED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, J3 LIMITED'S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS LICENSE AGREEMENT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE.
The Software is not fault-tolerant and is not designed or intended for use in hazardous environments requiring fail-safe performance.
Hazardous environments requiring fail-safe performance include the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, weapons systems, direct life-support machines, or any other application in which the failure of the SOFTWARE could lead directly to death, personal injury, or severe physical or property damage (collectively, "HIGH RISK ACTIVITIES").
J3 Limited expressly disclaims any express or implied warranty of fitness for HIGH RISK ACTIVITIES.
This Agreement is governed by the laws of the United Kingdom. If this product was acquired outside the United Kingdom, then local law may apply.
